Mr. Weber provides strategic guidance to businesses of all sizes, in litigation, alternative dispute resolution, and general counseling matters. He has extensive experience guiding clients through real estate and construction disputes, from inception through trial, and routinely represents developers, contractors, commercial landlords and tenants, and government entities in high-stakes matters.
In addition to his real estate and construction industry focus, Mr. Weber has wide-ranging commercial litigation experience in mergers-and-acquisitions (M&A) disputes, trade secret actions, business divorces, and litigation with public entities (including bid protests and procurement disputes).
Mr. Weber implements a results-oriented approach to meet his clients’ specific business needs. His multifaceted practice includes crisis management counseling, implementation of litigation avoidance strategies, expedited proceedings and injunction practice for emergency situations, cost-effective case management, and, when required, “bet-the-company” litigation through trial and appeals.
Mr. Weber maintains an active pro bono practice and serves on the Board of Volunteer Lawyers for Justice, a 501(c)(3) not-for-profit corporation providing legal services throughout the state of New Jersey.
Included on the Super Lawyers Rising Stars list for New Jersey, Mr. Weber has significant experience in expedited proceedings taking place in the Chancery Division of the Superior Court of New Jersey. Prior to joining the firm, he served as a law clerk to the Honorable Kenneth S. Levy, Presiding Judge, Superior Court of New Jersey, Chancery Division, General Equity Part, and he remains actively involved in the Equity Jurisprudence sections of the New Jersey and Essex County Bar Associations.
Mr. Weber is also a Rule 1:40 New Jersey Court Approved Mediator and has experience in a wide variety of alternative dispute resolution venues.
Areas of Focus
Real Estate Litigation
Mr. Weber represents developers, business owners, and commercial landlords and tenants in all facets of real estate litigation, including purchase-and-sale agreement disputes, lease disputes, quiet title actions, eviction, ejectment, and summary dispossess matters. He has extensive experience in the procedures of New Jersey’s Landlord/Tenant Court, as well as in the Chancery Division of the Superior Court of New Jersey, the venue of many real estate-related actions.
Construction Law & Litigation
Mr. Weber’s construction practice involves representing project owners, developers, and general contractors in contract negotiation, alternative dispute resolution (including arbitration), and litigation in state and federal courts. His litigation and arbitration experience includes the prosecution and defense of construction defect claims, faulty design claims, change order disputes, and delay claims.
Government Litigation
Mr. Weber has represented public entities in various litigation and counseling matters, including the New Jersey Sports & Exposition Authority (NJSEA), New Jersey Transit, New Jersey Department of Treasury, and the New Jersey Schools Development Authority (NJSDA). Mr. Weber has also litigated against public entities, including the Delaware River Port Authority (DRPA) and numerous municipalities. Mr. Weber has significant experience in the area of procurement law and bid protests, for both winning bidders and entities challenging procurement awards.
Complex Commercial Litigation
Mr. Weber represents clients in a wide range of complex disputes, including mergers-and-acquisitions (M&A) disputes, shareholder and limited liability company litigation, breach of contract actions, commercial torts, breach of fiduciary duty actions, and professional liability/malpractice litigation. He has experience in all stages of commercial litigation, from expedited injunction proceedings, discovery, and dispositive motion practice to trials and appellate practice.
Mediation
Mr. Weber is a Rule 1:40 qualified mediator and is listed on the New Jersey Superior Court roster of court-approved mediators. His experience as a litigator enables him to quickly assess not only the strengths and weaknesses of the parties’ positions, but also the cost, time, and other practical considerations of the parties’ disputes.
